1. Acceptance
By accessing or using burnbanradar.com (the "Site"), operated by Honeygoat GmbH ("we," "us," "the operator" — see the Imprint for full details), you agree to these Terms. If you do not agree, do not use the Site.
2. What the Site is
The Site reads publicly published burn-ban and fire-restriction information from U.S. state and county government sources and republishes it, county by county, with a timestamp and a link back to the original source. It is an aggregation and information tool. It is not a government service, it is not a legal record, and it does not issue, lift, or modify any burn ban.
3. No warranty — read this before you burn anything
THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
In plain language: we read government sources on a scheduled cycle and report what they say at the time we last read them. Sources can change between our checks, be temporarily unreachable, be incomplete, or word an order ambiguously — when that happens, we show a county as Unconfirmed rather than guess, but even a confirmed status can be stale by the time you read it. The county, parish, or agency order itself is always the only legally authoritative record. Before you burn anything, verify current status directly with the issuing county, parish, fire district, or state agency. Do not rely on this Site as your sole source before taking any action that could start a fire.
4. Not legal advice
Nothing on the Site — including status labels, penalty information, or explanatory text — constitutes legal advice. Penalty and statute references are provided for general awareness and may not reflect the current text of the law, local amendments, or how a specific violation would be charged. Consult a licensed attorney or the issuing agency for anything that requires legal certainty.
5. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONEYGOAT GMBH AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING PROPERTY DAMAGE, FINES, CITATIONS, OR PERSONAL INJURY — ARISING FROM YOUR USE OF, OR RELIANCE ON, INFORMATION FROM THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR USE OF THE SITE IS AT YOUR OWN RISK. IF ANY LIABILITY CANNOT BE LEGALLY EXCLUDED, IT IS LIMITED TO THE GREATEST EXTENT THE APPLICABLE LAW PERMITS.
6. Third-party sources and links
Every status on the Site links to the government page we read it from. We do not control those sites, do not vouch for their availability or content beyond what we cite, and are not responsible for anything on them. The same applies to any other external link on the Site.
7. Alerts feature
If you sign up for county status-change alerts, you are agreeing to receive occasional emails tied to that signup, governed by the Privacy Policy. You may unsubscribe at any time via the link in any alert email. We make no guarantee about alert delivery timing or completeness — the alerts feature is a convenience layer on top of the Site's data, not a substitute for checking the county page directly before burning.
8. Affiliate links and advertising
The Site may contain affiliate links and, in the future, advertising. See the Affiliate Disclosure page for details. Product recommendations, where they appear, are limited to items that remain legal to use under an active order (or that are useful once a ban is lifted) — we do not suggest ways around a legal restriction.
9. Intellectual property
The Site's design, code, text, and the specific presentation of aggregated data belong to Honeygoat GmbH and are protected by copyright. You may view, share individual page links, and quote small excerpts with attribution and a link back. You may not scrape, systematically copy, or republish the Site's county-status dataset as your own product or service, or use automated means to reproduce the Site's presentation at scale, without our prior written permission. The underlying facts — that a given county's government has declared a burn ban as of a given date — are public information and not, on their own, subject to copyright; what is protected is our specific collection, verification, and presentation of it.
10. Acceptable use
You agree not to: interfere with or disrupt the Site or its infrastructure; attempt to bypass any access controls; use automated tools to place excessive load on the Site; or use the Site for any unlawful purpose. Reasonable, low-frequency automated access (e.g., an occasional script checking one county's status) is fine; running a bulk scraper against the whole Site is not — use the government sources directly for that, or contact us.
11. Indemnification
You agree to indemnify and hold harmless Honeygoat GmbH, its operators, and Christoph Ballmer from any claim, loss, or damage (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right, including any fire, fine, or citation resulting from your own decision to burn.
12. Changes to these Terms
We may update these Terms from time to time. The date at the top of this page reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the competent courts at the operator's registered seat in Aargau, Switzerland, to the extent permitted by applicable law. This does not deprive you of any mandatory consumer-protection rights available under the law of your own country of residence.
14. Severability
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect, and the unenforceable provision will be read to accomplish its intent as closely as legally possible.
